AFTE Store - Joseph Ramirez vs. State of Florida – Supreme Court Decision, December 20, 2001
The Florida State Supreme Court handed down their decision in regards to the Ramirez vs. State of Florida case on December 20, 2001. The point at issue in this case was the identification of knife marks in human cartilage. In focusing on the demonstrable criteria for the identification of toolmarks, the Florida Supreme Court reviewed the testimony of five AFTE members who provided traditional justification for the identification of striated toolmarks throughout these proceedings based only on qualitative criteria established through “training and experience”. The Court found that these explanations did not satisfy Florida’s rigorous Frye standards for reliability. They therefore excluded all testimony regarding the knife mark identification and reversed Ramirez’s murder conviction. This decision has potentially significant ramifications for the future admissibility of firearm and toolmark evidence. We hope that by providing all members with the following decision, we will, as an association, be motivated to address these new challenges with more vigor.
